Welcome to Swing Loop. These Terms of Service ("Terms") govern your access to and use of the Swing Loop mobile application and website at swingloop.app (collectively, the "Service") operated by Swing Loop ("we," "our," or "us"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Swing Loop, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Swing Loop is a golf practice application that uses body movement detection to automatically record video of your golf swings. The Service is designed to help golfers review and improve their swing technique through hands-free recording.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Account and Access

Some features of Swing Loop may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree to use Swing Loop only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service in any way that violates applicable laws or regulations
• Record individuals without their knowledge or consent where required by law
• Attempt to reverse engineer, decompile, or disassemble the app
• Interfere with or disrupt the Service or its servers
• Use the Service to transmit malware or harmful code
• Resell, sublicense, or commercially exploit the Service without authorization
• Use automated systems to access the Service in an unauthorized manner

5. Device Permissions

Swing Loop requires access to your device's microphone and camera during active sessions. The camera detects body movement to trigger recordings and captures swing video; the microphone records impact audio. You may revoke permissions through your device settings, though this will limit app functionality.

6. User Content

You retain ownership of all swing videos and content you create using Swing Loop ("User Content"). By using the Service, you grant us a limited license to process your User Content solely to provide and improve the Service (e.g., on-device swing detection).

You are solely responsible for your User Content and represent that you have all necessary rights to create and store it.

7. Intellectual Property

The Swing Loop app, website, logo, design, and all related content (excluding User Content) are owned by Swing Loop and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Subscriptions and Payments

Swing Loop may offer free and paid features. If you purchase a subscription or in-app purchase:

• Payment is processed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are subject to the policies of the respective app store
• We reserve the right to change pricing with reasonable notice

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Swing detection will be accurate in all environments or conditions
• The Service will meet your specific requirements
• Any defects will be corrected

Swing Loop is a practice tool and does not constitute professional golf instruction or coaching advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWING LOOP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Swing Loop and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware, unless otherwise required by applicable consumer protection laws in your jurisdiction.

15. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
